CPNI and other FCC stuff

A former client just had a scrap with the FCC over filing his CPNI forms. He wasn't alone, see the list of CPNI fines here. Just for giggles, here is the YMAX CPNI filing. YMAX is the CLEC behind the MagicJack.

Reminder: CPNI Certifications are to be filed in FCC docket no. 06-36. Due by March 1st annually.

Who must file: All telecommunications carriers and all interconnected VoIP providers. Filing obligation applies to carriers who are de minimis for USF purposes. Filing obligation does not apply to private carriers.

WARNING: Last year, the FCC proposed base fines of $20,000 to companies that failed to file certifications or that filed certifications that did not comply with the rules.

On another FCC note: the FCC Notified Cbeyond Communications, LLC of its Apparent Liability for Forfeiture in the amount of $12,000 for violating the wireless handset hearing aid compatibility status report filing requirements. (DA No. 10-2049).

Voice isn't data. There is a mess of FCC and state filing requirements as well as a varying amount of taxes and fees to collect and disburse.
