EarthLink tells Court that FCC Sucks!

CNET writes: "Federal regulators acted illegally by not forcing the Bell companies to share their broadband networks with competitors, EarthLink told a federal appeals court on Tuesday." DSL Reports quotes "Earthlink attorney Mark O'Connor told the court that the FCC "failed to analyze the state of broadband in a rational manner," and "unlawfully eradicated the rights of broadband competitors to serve the public." Citing falling broadband prices as proof FCC policy is functioning, FCC lawyer Nandan Joshi argued that "it is not only unnecessary to require unbundling, it is affirmatively harmful.""
