Basically, Qwest thought the NSA needed a court order and Qwest was afraid of the liability for lawsuits and fines for giving out customer records. (He didn't know that the FCC would weaken and become nothing more than an RBOC Yes Club. Heck, the FCC didn't even fine the websites selling customer bill info).
